1. Scope and service provider
These Terms & Conditions govern the provision of private transfer services (including airport transfers) and private guided tours (together, the "Services") offered by Massimiliano Romano, operating under the trade name "Max Rome Executive Chauffeur", with registered address at Via G.B. Pergolesi, 48 — 00052 Cerveteri (RM), Italy, VAT number 11885461001, holder of NCC authorisation No. 949 issued by the Comune di Roma (the "Service Provider", "we", "us").
By making a booking through the website www.maxromeexecutivechauffeur.it (the "Website"), by e-mail, telephone or WhatsApp, you ("the Client", "you") accept these Terms & Conditions. These terms do not affect your statutory rights as a consumer under Italian law (Legislative Decree No. 206/2005, the Consumer Code).
2. Booking and contract formation
- A booking request can be made through the booking form on the Website, by e-mail, telephone or WhatsApp.
- The contract is formed when we send you a written confirmation (by e-mail or WhatsApp). Until confirmation, no obligation exists on either side.
- It is your responsibility to provide accurate details — in particular pickup address, date, time, and flight number for airport transfers. We are not liable for consequences of incorrect or incomplete information.
- Any change to a confirmed booking must be requested in advance and is subject to our written confirmation.
3. Prices and payment
- Prices are fixed per vehicle and per route, as displayed on the Website, and include fuel, tolls, parking during the service and all taxes.
- Vehicles are offered as a sedan car (up to 4 passengers) or a van (up to 7 passengers). Children of any age count towards the capacity.
- Custom transfers are calculated per kilometre; custom tours are calculated per hour, as shown in the Website's custom route builder. The estimate displayed is indicative and must be confirmed by us in the booking confirmation.
- Payment is made directly to the driver at the end of the service, in cash or by card as agreed with the driver. The Website does not process online payments.
- For tours extending beyond the included hours (where stated), each additional hour is charged at the rate indicated on the Website at the time of booking.
4. Waiting policy
- Airport pickups: 60 minutes of free waiting are included, calculated from the actual landing time of your flight. We monitor flight status and adjust the pickup time accordingly.
- Hotels and other addresses: 15 minutes of free waiting are included from the agreed pickup time.
- If you do not appear within the free waiting period and cannot be reached by phone or WhatsApp, the driver is entitled to depart and the full fare remains due.
- No additional waiting fee applies within these free periods.
5. Cancellation and no-show
- Free cancellation is available up to 24 hours before the agreed pickup time, without charge.
- For cancellations made less than 24 hours before pickup, or in case of no-show, the full fare is due.
- Pursuant to Article 59(1)(n) of the Consumer Code, the statutory right of withdrawal does not apply to transport services provided on a specific date or at a specific time.
6. Luggage
- The fare includes standard luggage: up to 2 large suitcases and 2 carry-on items per vehicle for a sedan; vans offer additional capacity.
- Oversized or unusual items (bicycles, musical instruments, sports equipment, large quantities of luggage) must be declared at the time of booking and are accepted at our discretion.
- We may refuse undeclared items that exceed vehicle capacity or regulations.
7. Passenger conduct and vehicle care
- Smoking (including e-cigarettes) and the consumption of food and alcohol inside the vehicle are strictly prohibited.
- The Client is financially responsible for damage to the vehicle or excessive soiling caused by the Client or their party, including professional cleaning costs.
- The driver may refuse carriage or terminate the service without refund in case of conduct that endangers safety, breaches these rules, or is abusive towards the driver.
8. Special requests
Special requests (e.g. language preferences, specific routing) must be communicated at the time of booking. They are noted but fulfilled at our discretion, unless expressly confirmed in writing.
9. Delays and force majeure
The Service Provider shall not be liable for failure to perform or delay caused by circumstances beyond its reasonable control, including but not limited to: unforeseeable or extraordinary traffic conditions, road accidents along the route, road closures, strikes, adverse weather conditions, natural events, public order measures, or other events of force majeure. In particular:
- While we plan routes and schedules with care, we cannot be held financially liable for missed flights or connections caused by such events, nor for indirect or consequential losses.
- In case of force majeure, we will use reasonable efforts to inform you and, where possible, to agree on an alternative arrangement. If the service cannot be performed at all, the amount paid or due for the unperformed service will not be charged.
10. Liability
- Our liability is limited to the price paid for the service, except for liability that cannot be excluded or limited under Italian law (including claims for death, personal injury or damages caused by wilful misconduct or gross negligence, covered by the mandatory motor insurance and NCC policies).
- Personal belongings remain the responsibility of the Client. We are not liable for items left in the vehicle; reasonable efforts will be made to return lost items if found.
- The Client is responsible for holding valid travel documents and meeting their travel deadlines; we do not guarantee arrival by any particular time.
11. Website use and intellectual property
The Website and its content (texts, images, logos, prices and design) are protected by intellectual property rights and may be used only for personal, non-commercial purposes in connection with our Services. Any reproduction or commercial use without written authorisation is prohibited.
12. Complaints
Complaints must be submitted in writing to maxromeexecutivechauffeur@outlook.it within 14 days of the service date, describing the issue. We will respond promptly and in good faith.
13. Applicable law and jurisdiction
These Terms & Conditions are governed by Italian law. For consumers, the courts of the place of residence or domicile of the consumer shall have jurisdiction where so provided by law; for all other disputes, the courts of Rome (Italy) shall have exclusive jurisdiction.
